English Requirements for the Subclass 186 visa

The Subclass 186 visa, otherwise referred to as the Employer Nomination Scheme (ENS) visa, is a permanent visa that allows the holder to live and work in Australia permanently. The holder must be nominated by their employer. There are certain English requirements for the Subclass 186 visa which are compulsory. The requirements depend on the stream that is being applied for.

In this article, we will explore the English requirements based on the Subclass 186 visa stream you are applying under. The Subclass 186 visa has 3 streams:

Subclass 186 visa English requirements – Direct Entry (DE) stream

You must have at least competent English to be granted the Subclass 186 visa in the Direct Entry (DE) stream.

To prove you have competent English, the applicant must provide evidence that they:

  • are a citizen of, and hold a valid passport issued by, the United Kingdom*, the United States of America, Canada, New Zealand or the Republic of Ireland
    *British National (Overseas) passports are not acceptable as evidence of competent English.
    OR
  • you have an obtained one of the following English language test results:

The English test cannot have been undertaken more than 3 years before the date of application for the Subclass 186 visa to meet the English language requirements.

Subclass 186 visa English requirements – Temporary Residence Transition (TRT) stream

You must have at least competent English to be granted the Subclass 186 visa in the Temporary Residence Transition (TRT) stream.

As a result, you must provide evidence of having achieved the required minimum test scores in a specified English language test that has been conducted within three years immediately prior to the date of your application unless you hold a valid passport issued by the United Kingdom, the United States of America, Canada, New Zealand or the Republic of Ireland as evidence that you are a citizen of that country.

Are exemptions available?

From 16 November 2019, there is no exemption to the English language requirement for the Direct Entry (DE) stream or Temporary Residence Transition (TRT) stream of the Subclass 186 visa.

Subclass 186 visa English requirements – Labour Agreement (LA) Stream

The English requirements for applicants who apply for the Labour Agreement (LA) stream must demonstrate that they have:

The English language skills that are suitable to perform the occupation to which the position relates.

This will be the same level of English as for the other visa streams outlined above, unless otherwise specified in the labour agreement.

English Requirements for included family members in the Subclass 186 visa

You can include family members* in your application when you apply, or alternatively you can add family members to your application after you apply, but before a decision is made on the visa application.

Any family member included in your application who is 18 years or older must be able to provide evidence that they have Functional English. If your family member cannot provide evidence of Functional English ability, you are also able to make payment of a second instalment at the time of decision. At the time of writing this article, the fee per family member is AUDTY$4,890.

To prove you have functional English, show evidence that:

  • you are a citizen of and hold a valid passport issued by the United Kingdom*, the United States of America, Canada, New Zealand or the Republic of Ireland. *British National (Overseas) passports are not acceptable as evidence of functional English.
    OR
  • ​you completed a degree, a higher degree, a diploma or a trade certificate in an institution in or outside Australia that required at least two years of full-time study and all instructions were in English
    OR
  • you undertook your education at:
